How many days of statutory maternity leave are there in China in 2026?
Under the Special Provisions on Labor Protection of Female Employees, female employees receive 98 days of maternity leave, of which 15 days may be taken before delivery. Difficult delivery, including caesarean section, adds 15 days, and each additional baby in a multiple birth adds a further 15 days. On top of this, each province adds 60 to 90 days of bonus or extended leave through its Population and Family Planning Regulations, so actual maternity leave reaches 158 days or more in all 31 provinces.
How many days does each of the 31 provinces give?
Under current 2026 policy, for a normal delivery of a first child: 158 days (98+60) in Beijing, Tianjin, Shanxi, Liaoning, Shanghai, Jiangsu, Anhui, Shandong, Hubei, Hunan, Sichuan, Guizhou, Yunnan, Ningxia and Xinjiang, plus Fujian (whose regulations specify 158 to 180 days, counted here at the lower bound); 178 days (98+80) in Guangdong and Chongqing, where Chongqing also permits leave until the child's first birthday with employer approval; 180 days in Jilin (from 2024), Heilongjiang and Gansu; 188 days (98+90) in Jiangxi, Henan, Hainan and Qinghai; and Tibet is the longest at one full year (365 days). Five provinces vary by birth order: Hebei and Inner Mongolia give 158 days for a first or second child and 188 for a third; Zhejiang gives 158 for a first child and 188 for a second or third; Guangxi gives 158, 168 and 178 days respectively; and Shaanxi gives 158 days for a first or second child and 173 for a third.
How much paternity (nursing) leave does each province give?
Shanghai gives 10 days. Beijing, Tianjin, Hebei, Shanxi, Heilongjiang, Jiangsu, Zhejiang, Fujian, Shandong, Hubei, Guangdong, Hainan, Guizhou, Qinghai and Xinjiang give 15 days. Shaanxi gives 15 days, extended to 20 for couples living apart, with a further 10 days for a third child. Liaoning, Hunan, Chongqing and Sichuan give 20 days. Inner Mongolia, Jilin, Guangxi and Ningxia give 25 days. Anhui, Jiangxi, Henan, Yunnan, Gansu and Tibet give 30 days. Wages continue during paternity leave and benefits are unaffected.
Which day does maternity leave start from, and are holidays included?
Maternity leave is generally counted continuously from the day of delivery, and up to 15 days may be taken before the birth, counted within the 98-day base. Leave is measured in calendar days, so public holidays and weekends count toward the total and do not extend it. This tool counts from the delivery date by default, so move the start date earlier if you plan to take prenatal leave.
Does a caesarean count as difficult delivery, and does it add 15 days?
National rules add 15 days for difficult delivery, and most provinces treat caesarean sections and forceps deliveries as difficult in practice. The difficult delivery option in this tool applies that +15 days. A few regions interpret this differently, so confirm with your local human resources and social security bureau and your employer.
How are wages paid during maternity leave?
If maternity insurance has been paid, the maternity insurance fund pays a maternity allowance based on the employer's average monthly employee wage for the previous year. Without insurance, the employer pays at the pre-leave wage level. Where the allowance falls below the employee's own wage, most regions require the employer to make up the difference. Treatment during bonus leave varies slightly by province, so local rules govern.
Is the calculated result legally binding?
The tool follows current national rules and provincial Population and Family Planning Regulations and birth support policies as of 2026, and results are for reference only. Local policy can change, as when Jilin raised maternity leave to 180 days in 2024, so actual entitlement and benefits are governed by your employer and the local human resources and health authorities.
